What happens to collections when you pay original creditor
Thank you first for taking the time to read and answer my questions.
I sent the dispute letter to Audit and Adjustment - they sent me a letter back that says they marked the account as disputed and will be reported to the national credit reporting agencies.
Mind you I did not change your dispute letter at all. Also I was told that if I could get valley medical center to cash a check - that that means I am working with them and they are working with me - cutting out the collector per say is that true????
I did not a get a validation of debt from audit and adjustment. I don't know what to do now...And as far as I can tell the bureaus aren't really checking into things - because I have paid off a bunch of stuff and it still hasn't changed my report any. If I missed something in your writing would you let me know where to go read again please.

Credit Report
MY husband and I have been working on our credit report for a little while and have all of our past debts paid in full. Now all we have is one more left. Our problem is i called to settle the debt and they have no record of our account what so ever. I have given them our S.S.# and everything i possibly could to get this debt settled. Now this debt is the only thing that is keeping us from getting the house we want. How do i take care of something that i can't fix now. I tried to make our wrong a right but now i can't. The debt is a repo through Capitol One auto finance. Will the credit reporting company's take this off since Capitol One has no record of it in their system. If not do you have any advise for us

Creditor not playing fair
Hey Bo, I sent a creditor a debt validation letter as per your advice. They failed to respond within the thirty days required by the FCRA. I sent the letter certified and I have proof that it was received. I sent a second letter to inform them that they have failed to verify this debt and by law MUST remove it from my credit file. That letter was also sent by certified mail. I still havent had any response. What should I do next? Thanks for all your help...Jay Jay

CA (Collections Agency) posted the sold account on my report
I just pulled my report and saw that the CA (Collections Agency) posted the sold account on my report. Is it legal for the original debtor, AND the collections agency post the same debt on my account? Can I get one or the other removed? AND, can they repost it again and again, even if I dont contest it? I heard that after 7 years after the "ORIGINAL" account was posted, that it has to be removed and the CA cant repost it over and over and over.... Please shed a light on this subject via email, and on your site... if I overlooked it on your site, I apologize

FICO score question
How do I know what past debt to pay off first in order to raise my FICO score FAST? Is it true that I should pay the most recent items first? Thank you

i would negotiate to have the most recent or less than 2 years old accounts removed from my report if i pay in full right notget signed on compnay letterhead agreement before you make payment in full if they will not remove it, pay it anway and, it will show zero balance which will help your score. anything more than 5 years old i might ait out for it to fall off or validate and dispute the debt hoping to get lucky my negotiation travails

Dispute and validate with 3 companies
I sent off validation letters to 3 companies I've been battling with over questionable items on my reports for quite some time. The letters were all received on the same day and the 30 deadline to respond to me expired on the 4th of this month. I am unsure what steps to take at this point. Do I send them another letter demanding it be removed immediately due to them not meeting the 30 day deadline? Is there a particular part of the FCRA I can quote to them demanding it now be removed from report seeing that they have not responded?

old collections on my credit report is paid and closed
Q: I have an old collections on my credit report that has been in the paid/closed status for two years (I wish I had seen your site two years ago). I have heard that you can dispute these old collections as many collections agencies do not respond if the account has been paid and old. Is it bad to try and dispute a paid collections, or is it best to leave it as is? Is there any risk in doing this?

Mail your disputes, inquiries and updates to these addresses.
Use this credit dispute form to get addresses to creditors, remove errors and add comments. To get an address, just mark not my account and fill in dates, amount and creditor for the entry. The entry will either be removed or you will receive a letter saying the account was verified with contact information so you can hash out differences with the creditor. So use this form to find addresses of creditors. To remove errors state the errors with the form units and mail to bureaus. If you have improper credit entries like, fraud alerts, marked as dead, credit freezes, stolen identity or merged files, more than 7 years old, incorrect dating, duplicates or just plain errors use this form. If needed send a 100 word or less explanation of your problem or complaint. If you can negotiate first with a creditor and get information changed. Write or call the creditor and make arrangements to pay off in full or re-open and account with agreement to eliminate bad marks after 24 months elapse. Most credit card companies only report the previous 24 months and most collection agencies will remove entries if you pay them off in full including fees. Expect car loans, home loans, utilities and matters of law to very difficult if not impossible to get changes made. Most of the accounts take 7 – 10 years to fall off by law. Print and mail the dispute form for accounts were you find creditors hard to find yourself. Many times a creditor has moved or been sold or even gone out of business. These accounts should fall right of because the bureaus will not get a response in less than 30 days. So the longer it takes for the bureaus to respond the better your chances are the account will be deleted. Make your dispute form simple by breaking up large groups of disputes into groups of 4 or less. More than 4 disputes per form can sometimes be kicked out as frivolous. ie. If you dispute EVRYTHING on your report that must be frivolous unless you suspect fraud or merging. Include very detailed personal information such as a copy of your drivers license, social security card, phone bill, insurance, card, birth certificate on matters of fraud, merged files, or and even reporting person is deceased when person is clearly alive. Include only basic personal information when disputing unfamiliar or old accounts hoping for a mistake by a creditor or bureau that would delete the account entry. You can add a 50-100 word or less comment to any account on your report which you have a disagreement with a creditor. Just write a letter about a specific account (name, amount, date) then include necessary personal information and mail it to the bureaus above. The comment will now help your score but will help potential creditors make decision on credit applications. Use the dispute form to make sure all your accounts that were included in a bankruptcy showed included in bankruptcy and a 0 balance owed. Bankruptcies do not remove accounts but they the accounts should show included in Bk and 0 balance owed. If you are married and your spouse has the same data you have disputed make sure you do another dispute form letter for your spouse. The instructions below are detailed instructions listed on the web by the FTC on how to correct errors.Correcting ErrorsUnder the FCRA, both the CRA and the organization that provided the information to the CRA, such as a bank or credit card company, have responsibilities for correcting inaccurate or incomplete information in my report. To protect all my rights under the law, contact both the CRA and the information provider.First, tell the CRA in writing what information I believe is inaccurate. Include copies (NOT originals) of documents that support m position. In addition to providing m complete name and address, my letter should clearly identify each item in my report I dispute, I state the facts and explain why I dispute the information, and request deletion or correction. I may want to enclose a copy of my report with the items in question circled. I send my letter by certified mail, return receipt requested, so I can document what the CRA received. Keep copies of m dispute letter and enclosures.CRAs must reinvestigate the items in question--usually within 30 days--unless they consider my dispute frivolous. They also must forward all relevant data I provide about the dispute to the information provider. After the information provider receives notice of a dispute from the CRA, it must investigate, review all relevant information provided by the CRA, and report the results to the CRA. If the information provider finds the disputed information to be inaccurate, it must notify all nationwide CRAs so they can correct this information in my file. Disputed information that cannot be verified must be deleted from my file and never replaced.If my report contains erroneous information, the CRA must correct it. If an item is incomplete, the CRA must complete it. For example, if my file showed that I was were late making payments, but failed to show that I am no longer delinquent; the CRA must show that I'm current. If my file shows an account that belongs only to another person, the CRA must delete it. When the reinvestigation is complete, the CRA must give me the written results and a free copy of my report if the dispute results in a change. If an item is changed or removed, the CRA cannot put the disputed information back in my file unless the information provider verifies its accuracy and completeness, and the CRA gives me a written notice that includes the name, address, and phone number of the provider.Also, if I request, the CRA must send notices of corrections to anyone who received my report in the past six months. Job applicants can have a corrected copy of their report sent to anyone who received a copy during the past two years for employment purposes. If a reinvestigation does not resolve my dispute, ask the CRA to include my statement of the dispute in my file and in future reports.Second, in addition to writing to the CRA, tell the creditor or other information provider in writing that I dispute an item. Again, include copies (NOT originals) of documents that support my position. Many providers specify an address for disputes. If the provider then reports the item to any CRA, it must include a notice of my dispute. In addition, if I am correct-that is, if the disputed information is not accurate-the information provider may not use it again. Accurate Negative Information When negative information in my report is accurate, only the passage of time can assure its removal. Accurate negative information can generally stay on my report for 7 years. There are certain exceptions:Information about criminal convictions may be reported without any time limitation. Bankruptcy information may be reported for 10 years. Credit information reported in response to an application for a job with a salary of more than $75,000 has no time limit. Credit information reported because of an application for more than $150,000 worth of credit or life insurance has no time limit. Information about a lawsuit or an unpaid judgment against me can be reported for seven years or until the statute of limitations runs out, whichever is longer. Criminal convictions can be reported without any time limit. Adding Accounts to MY FileMy credit file may not reflect all my credit accounts. Although most national department store and all-purpose bank credit card accounts will be included in my file, not all creditors supply information to CRAs: Some travel, entertainment, gasoline card companies, local retailers, and credit unions are among those creditors that don't. If I've been told I was denied credit because of an "insufficient credit file" or "no credit file" and I have accounts with creditors that don't appear in my credit file, ask the CRA to add this information to future reports. Although they are not required to do so, many CRAs will add verifiable accounts for a fee. I have a foreclosure still on my report. What can i do to remove it now
Hey Bo, Thanks for all your help. I have raised my credit score 120 pts in 6 months. I have a foreclosure still on my report. The house has been sold and I show a zero balance on my report. Transunion has an estimated date of removal of 10/2008. My question to you is...what can I do to remove it now? If I cant get it removed now, Is it guaranteed to be removed in October? Thanks

reassesed a debt that is over 7 years old
A company on my credit report reassesed a debt that is over 7 years old. Im trying to fix it but they say its mine... I have disputed the bureas and heres the thing - Its been 30 days and it still shows on my credit reports that the items are still under dispute? What can I do ?
Should I write to the bureaus and tell them to remove the items disputed because its been longer than 30 days???

Bo after the company receives your letter they have 30 days from the date of receiving the letter to validate. If they do not what should I do next.

Credit Card is lowering our limit raising interest rates for being close to our limit
My husband and I have a unique situation regarding a single credit report error that wasn't, to the best of my reading, addressed on your website. Although we have a high amount of debt ($90K), we have an excellent credit score (800+) due to many years of diligent, timely payments.
However, in 2002, we learned of a bad mark on our report (which we feel was in error), and we wrote the attached letter to Equifax, Experian and TransUnion (which explains all the details). My husband swears that this had been taken care of in 2002, but we just received a letter from two credit card companies that due to having approached/reached our credit limit, along with a report recently viewed on our credit report, they are lowering our limit and raising our interest rates.
We just purchased another copy of our credit report and were astonished to see this mark still on our report. We cannot locate any other documentation other than the attached letter, and the company through whom we made the purchase (and who made the billing error) is no longer in business.
The details surrounding our circumstance are fully explained in the letter (the only change is that our personal info has been blocked out).
Since our case is beyond validation and negotiation (and the debt was paid eight years ago), is there any course of action we can now take to remove this mark from our report and convince these two credit-card companies (to whom we've been loyal customers for many years) that the mark was an error and to lower our interest rates?

I see your point (in fact, that's what we thought), but I guess two of our credit card companies seem to care about that negative report. They just decreased our limit and raised our APR by 7% - based on 2 things: the fact that we reached our limit, and this negative mark they saw on our credit report.
How can a dispute for a negative report 7-years old be judged in our favor when the reporting company has been out of business for 6 years? And if we send this dispute form to the bureaus, how can we expect different results than the first time we disputed it?

Credit card company rules, always state, they can raise your rate for going over the limit or being one day late on any payment. AND THEY ALWAYS DO. i know I've done it over and over.

Injured while active duty AF 1977, placed of TDRL, medical collection judgment
I was injured while serving active duty in the AF in 1977. I was placed on TDRL (Temporary Disability Retirement List) and sent home to work a regular job and receive a 50% comp, while still a member of the USAF. In 1980 they medically retired me. The Veterans Admin, then picked me up. I had worked close to 75 jobs between 1980 and 2003. I had been fired from every one of them due to my memory problems and double vision (up close) caused by being hit by a fire truck while taking Air Force documents to the city's courthouse from my base. I was in a coma for several months and the hospital for nearly a year.
My credit was excellent until I lost my last job in late 2003. In January of 2004 the VA re evaluated me and concluded that my disability had gotten a lot worse, and raised my percentage to 100%. The only income I have is my disability monthly checks. All 3 of my past due bills were taken out while still working and receiving 50% comp. I now have 2 judgements against me and another one I expect to be filed anytime. I can not work, and my disability will never get better. I am "totally and permanent disabled". The judge that handled my judgements told me that I have a case for a "total and permanent disability discharge", but nothing could be done because no action has been taken to garnish my wages or any other action.
I talked to the local Bar Association yesterday and they told me that these debts are "non collectable secured debts". Since I started receiving my 100% compensation my credit has been excellent. It is just the 3 debts that I acquired before my total disability. Is there any way to get these debts removed? My credit scores are 587, 588, and 446. I also can't understand how 2 can be where they are and the other one so low. Any advice for me? I would appreciate any guidance. The bar association also told me that they could never touch my disability income. But if I would like to buy a small house someday, I want to have decent credit. Thank You

recieved letter from collector, they will not respond being frivalous
Thank You for the advice about the dispute letter. I have just recieved a letter from a collector that has told me they are not going to respond to my request because I am being frivalous. Now, should I send my debt validation letters to the credit bureaus in this case or send the validation follow up letter? Thank you.

dsiputes go to bureaus, who then send them to creditors. bureaus usually respond with a "frivilous", not creditors.
debt validation lettters go to collectors or collections and most collections are not legal. These collections are sold for pennies on the dollar in many cases and provide a very high rate of return if the collector can actually collect. Collection agancy's can try to collect BUT, you cannot be sued or threatened of a possible suit and the collection cannot be placed on your credit report, if, the item has already been put on your report by the original creditor.

Dispute on unverifiable debt can not get any help
August 2006 disputing the amount owed and requesting they investigate and respond to me. By November I had not heard anything so I sent another letter requesting that they either provide the information I initially requested, or remove this debt from my credit reports, still no response. So I disputed with the bureaus to remove the debt, but they only verified the information and told me I needed to contact the creditor. Yesterday I called the creditor, who I had a couple of different issues with, but they still did not have a response for me, and need to do additional follow up. One of their representatives told me they did not have to respond to me in writing, it would be a courtesy if they called me. Apparently this person does not know the fair credit reporting act. I would like your input on this, but I am about to file a complaint with the FTC, BBB. and my state attorney.

If you do not ow what it is
or they cannot provide a copy of the item you request
just call your state attorney.

Hi, I've read quite a few posts on your blog, not sure how to post one myself? my question is -I have 2 student loans that were delinquent and each one appears to be listed 3 times on my credit report - each one says condition "derogatory" and pay status "120 days late" I am now paying on them and those two accounts are correctly reported as "current" each entry is listed by Iowa Student Loan, so when my report is pulled, it looks as though I'm not paying on 4 of my accounts. I've tried disputing them with no luck, there is a remark on them that says "student loan perm assign to government" I've called the student loan people and they confused me even more. what other options do I have?
I've used some of your advice on other issues with great results! Had a lot of negative information removed by disputing - EVEN A JUDGMENT! Increased credit score by 40 points in 30 days! Thanks

what did the dispute reply say
did it give the same address and phone number you used to get confused by Iowa student loan.
if so, and it sounds like that's what happened, you should talk to ISL again and again until you get it straight. There has to be different account numbers for these accounts. Many times a loan company will re do the loan to overcome a consumer being late on the loan companies books. They can't just, out of the blue say, you are not late unless you pay up or they redo the the loan.
I would think you could dispute or negotiate to have those, other, showing late now, loans to "say same account', "duplicate account" as the one being paid on.
When you dispute these items someone is verifying them somewhere. But this someone should say these accounts are now combined with another account and should show zero balance.
The accounts will still show you were late once upon a time, but they should not show you are late NOW.
You might use the account numbers to get a letter from ISL, on ISL letterhead, that says these accounts were combined with accountabc which is now being paid in time.
There is no easy answer but. DIG IN. You can do it.

Local doctors office bill went to collection. Not notified
I had a bill with a local doctor's office. They only claimed to have one person working in the office and when my husband and I called to request statements - it was always an issue of they'd print it out and mail it that day. Well - we never received the statements - time passed and we finally received one that said we were being sent to collections.
So now here we are trying to get in touch with a well known collection agency. The number we dialed never worked and would always cut off. Finally my husband went through several prompts and said we had 4 months to pay the total - which was only 180.00. We decided to break it up into 3 months and send payments. When they woman finally called - she said I would not like the letter I requested with the remaining balance. To sum it all up we could never get in touch with the agency and now it's showing up on my credit report.

you made a mistake by paying without confirmation
its ok though
what to do now.
dispute the account as paid in full zero balance
get the results and mail your payment copies to the address provided from the dispute if the dispute is verified and they say you still owe money. if not its over.
then validate the debt with certified delivery mail
go all the way to state attorney general if needed.
you said you paid and it still shows up
so that is the assumption i am making here
really one should try to negotiate with the doctors office first. Read what I did on that page.
but in this case someone has taken your money and something has to be done with them
